67 Delivery
Terms of Service
Takes effect on October 18, 2026
Version: terms-2026-10-attorney-v1-1
Acceptance and eligibility
Attorney-revised (Version 1.1) — not yet in force
By affirmatively accepting these Customer Terms through the Platform or signing them, you agree to sections 1 to 4 and the applicable general provisions in section 12. You must be at least 18 and legally able to contract; alcohol purchasers and recipients must be at least 21. Section 9 applies to content you upload, and section 8 describes our information practices.
The Arbitration Agreement in section 4 affects court, jury-trial and class-action rights for covered disputes. You may opt out within 30 days after first accepting it. Qualifying small claims and the other stated exceptions remain available.
Platform role and ordering
Attorney-revised (Version 1.1) — not yet in force
67 Delivery operates a technology, logistics, ordering, discovery, and delivery platform connecting customers with participating retailers, restaurants, and other eligible businesses. Except where expressly stated otherwise, merchandise is sold by the participating business, not by 67 Delivery. For alcohol, the participating licensed retailer is the Vendor of Record. 67 Delivery acts as a technology and contracted delivery/logistics provider.
Depending on the order type, an independent 67 Delivery driver may pick up a completed order or shop for, purchase, collect, and deliver customer-selected merchandise. Under the current driver-shop model, the driver controls operational shopping progress; partners do not create artificial Preparing, Ready, or Handoff states.
For a supported shopping order, the customer appoints 67 Delivery and the assigned Driver as limited purchasing agents to obtain authorized products from the identified Partner using the approved payment method. This does not authorize an alcohol resale, purchase from an unapproved seller or unauthorized substitution. The licensed retailer remains responsible for lawfully accepting and completing its alcohol sale.
Product availability and substitutions
Attorney-revised (Version 1.1) — not yet in force
At launch, drivers may not substitute another brand, product, package size, flavor, or similar item unless the customer has authorized the substitution through a 67 Delivery-supported workflow. Unavailable items must be reported through the platform.
Any resulting price change must be disclosed and any additional authorization required obtained before charging for an approved substitution. Unfulfilled merchandise must be removed from the charge or refunded.
Pricing
Attorney-revised (Version 1.1) — not yet in force
Prices shown through 67 Delivery may differ from a partner's in-store or direct-sale price. Under the Partner-authorized retail arrangement, 67 Delivery may independently determine customer-facing display prices, platform markups, delivery charges, service fees, and other clearly disclosed platform charges. For alcohol, the arrangement must preserve the licensed retailer's lawful role as seller and must not create an unlicensed resale. Customers must be shown the applicable total before purchase.
Before you submit an order, the checkout will show the available item prices, applicable fees, estimated or final taxes, any selected tip and the total or clearly identified authorization amount. We will explain any estimate that may change because of approved substitutions, actual quantities or weights. Additional charges beyond your authorization require the consent required by law and the applicable payment workflow. We will not describe a Platform fee as a government tax.
Promotions, tips and taxes
Attorney-revised (Version 1.1) — not yet in force
Promotional terms disclosed when an offer is made govern eligibility and expiry. Tips are voluntary, are not a substitute for fees, and are intended for the driver. A tip associated solely with an undelivered order will be refunded unless you expressly choose to tip for services actually performed. Tax is handled by the legally responsible seller or collector under the applicable transaction flow; this does not alter your right to an accurate receipt.
Delivery arrangements
Attorney-revised (Version 1.1) — not yet in force
Provide an accurate, accessible delivery address and lawful delivery instructions. Delivery times are estimates and may be affected by shopping, traffic, weather, safety, verification or Partner operations. Drivers may decline unsafe or unlawful instructions. Notify support promptly if the address or recipient details are incorrect. A requested change is effective only when confirmed through the Platform.
For non-alcohol orders, a supported unattended-delivery option may be used in accordance with your instructions. Alcohol is subject to section 2 and must never be left unattended. We may record permitted delivery evidence, such as a completion timestamp or a photograph of non-alcohol merchandise, consistent with section 8. Do not ask a driver to photograph or retain sensitive information unnecessarily.
Accounts and conduct
Attorney-revised (Version 1.1) — not yet in force
Customers must provide accurate information and protect account credentials.
Notify support promptly of suspected account or payment misuse. Customers are responsible for orders they authorize; these Terms do not impose automatic liability for unauthorized transactions or waive payment rights available under law.
Fraud, identity misuse, unauthorized payment use, promotion manipulation, security interference, and unlawful use are prohibited.
67 Delivery may restrict or suspend access for fraud, safety, payment abuse, security, legal, or material policy concerns.
Restrictions do not extinguish accrued refund rights or other non-waivable rights. Customers must not threaten or harass Drivers, Partners, support personnel or other users.
Alcohol: licensed retailer and licensed premises
Attorney-revised (Version 1.1) — not yet in force
Each alcohol order must identify its actual licensed retailer and licensed premises. Delivery is performed under an authorized retailer delivery arrangement. Product- and licence-specific conditions, including applicable restaurant food-order, packaging, receipt, timing and transport requirements, must be satisfied. Drivers assigned alcohol deliveries must be at least 21. Nothing in this Policy permits an unlawful sale or delivery.
Alcohol: age, recipient and verification
Attorney-revised (Version 1.1) — not yet in force
Purchaser and recipient must be at least 21.
Alcohol is delivered to the named purchaser only at launch after successful identity and age verification.
No driver may informally substitute another adult at the door.
No unattended, porch, lobby, or contactless alcohol drop-off is permitted.
67 Delivery may require the driver's device to scan, validate, or otherwise document an eligible identification credential.
67 Delivery does not routinely retain a physical image/scan of the customer's ID; required verification result, timestamp, method, refusal reason, and compliance record may be retained.
Identification must be valid, unexpired and acceptable under applicable law and the supported verification workflow. A verification provider may process the credential under its disclosed practices. Any additional incident or legally required evidence is retained with restricted access as described in section 8.
Alcohol: mandatory refusal
Attorney-revised (Version 1.1) — not yet in force
Recipient is under 21.
Valid acceptable identification is unavailable, invalid, expired, or cannot be verified.
Recipient refuses required verification.
Person attempting to receive the order is not the named purchaser or, if later supported, the exact pre-authorized adult recipient.
Recipient appears visibly intoxicated.
Circumstances indicate likely furnishing to a minor, material safety risk, or unlawful delivery.
Drivers will not be penalized for a good-faith lawful alcohol refusal.
Alcohol: return and failed delivery
Attorney-revised (Version 1.1) — not yet in force
Refused alcohol must be returned to the originating licensed retailer/Vendor of Record under the 67 Delivery return workflow. The operating target is return within approximately one hour when reasonably practicable; safety, law, active delivery, product integrity, and retailer instructions control. For mixed orders, refusal of alcohol does not automatically require identical treatment of lawful non-alcohol merchandise.
The return must be acknowledged with the order, products and quantities, condition, refusal reason and time. If the retailer is closed or rejects the return, the Driver must contact support immediately for a safe, lawful custody and return arrangement. Informal disposal, home storage without lawful authorization or redelivery to an unapproved person is prohibited. Necessary lawful return work is compensated under section 6.
Alcohol: required checkout disclosure
Attorney-revised (Version 1.1) — not yet in force
Required checkout disclosure for alcohol orders: "Alcohol delivery fees are non-refundable upon failed age/sobriety verification, to the extent permitted by law and subject to the stated exceptions." The order-specific fee and exceptions in Schedule 3 must be shown prominently before payment. The acknowledgment must not be pre-checked and must be recorded with the account, order, timestamp and disclosure version, separately from optional marketing consent.
Alcohol: fee treatment when verification fails
Attorney-revised (Version 1.1) — not yet in force
Where alcohol delivery fails because the recipient fails age or sobriety verification, the separately disclosed alcohol delivery fee for the attempted service is non-refundable to the extent permitted by law, provided you affirmatively accepted the disclosure before payment. This rule does not apply where the failure results from our error, Partner error or a malfunction in the required verification process. It does not authorize retention of the price of unfulfilled merchandise, refundable tax, unrelated charges or a tip without the treatment stated in these Terms.
The price of unfulfilled merchandise and applicable refundable tax must be refunded or the authorization released through the approved payment flow. The alcohol component of a mixed order is reconciled separately from delivered lawful merchandise. A tip solely associated with an undelivered order is refunded unless the customer expressly chooses to tip for services actually performed.
Alcohol: no automatic restocking fee
Attorney-revised (Version 1.1) — not yet in force
No automatic restocking fee applies. A separate return charge may be used only if lawful, consistent with the retailer's lawful policy, disclosed with its amount or calculation before purchase and affirmatively authorized where required. It cannot be added retroactively or override a required refund or remedy for platform or retailer error.
Required refunds and payment corrections
Attorney-revised (Version 1.1) — not yet in force
Required refunds and payment corrections will be provided for missing, incorrect, unavailable, damaged or unfulfilled merchandise, duplicate or unauthorized charges, platform errors and cancellations authorized by the Platform or required by law. Discretionary goodwill credits may be considered separately. Required monetary refunds will not be replaced with platform credit without the customer's agreement or another lawful basis.
A customer-caused delivery failure does not automatically require a refund of a lawfully earned, disclosed service fee. This includes a wrong address, unavailability, failed verification, an unpermitted recipient, visible intoxication or an attempted unlawful transaction. Merchandise, tax, tips and other charges must nevertheless be assessed separately under section 2 and applicable law. No undisclosed fee is created by these Terms. Fraud and refund abuse may be investigated without extinguishing lawful chargeback, unauthorized-payment or refund rights.
Requests, cancellation and processing
Attorney-revised (Version 1.1) — not yet in force
Contact support with your order number and a description of the problem. We will review missing, incorrect, unavailable, damaged or unfulfilled products; duplicate or unauthorized charges; Platform errors; and cancellations authorized by the Platform or required by law. Reasonable evidence may be requested, but we will not require unsafe conduct or unnecessary sensitive information as a condition of reviewing a claim.
Cancellation availability and any lawful charge depend on whether shopping, preparation, purchase or delivery services have begun. Any cancellation charge must be disclosed before the affected purchase. Where an order fails because you provide an incorrect address, are unavailable or seek an unlawful delivery, we may retain only charges lawfully earned and disclosed; we will separately determine the treatment of goods and refundable amounts. If a fee was not disclosed and authorized as required, these Terms do not create it.
We will acknowledge a refund request promptly, investigate it reasonably and communicate the outcome or any information needed. After approving or determining a refund to be due, we will initiate it promptly to the original payment method unless you agree to another lawful method. Your bank or payment provider may require additional processing time. We will provide available confirmation of the refund or authorization release.
Mixed orders and your payment rights
Attorney-revised (Version 1.1) — not yet in force
For mixed orders, we assess delivered and refused items separately. A retailer refund to a purchasing card does not complete the customer refund; the corresponding customer payment must also be corrected. We may investigate fraud and repeated abuse, but an investigation does not eliminate your lawful chargeback, unauthorized-payment, statutory or required refund rights. Contacting support is encouraged and is not a waiver of those rights.
Individual arbitration
Attorney-revised (Version 1.1) — not yet in force
Except as stated below, you and 67 Delivery agree to resolve disputes between us arising from these Terms, the Platform, ordering, delivery, payment or related representations by binding individual arbitration. The Federal Arbitration Act governs to the extent applicable. Florida substantive law applies subject to mandatory protections that cannot be displaced by agreement. The AAA will administer the arbitration under its applicable Consumer Arbitration Rules and Consumer Due Process Protocol, together with its applicable Mass Arbitration Supplementary Rules where relevant. Rules and filing information are available at www.adr.org.
Arbitration replaces trial in court for covered disputes. Each party may seek the relief available for its individual claim under applicable law, including statutory remedies, reasonable legal fees where authorized and individual injunctive relief. Qualifying individual small claims may be brought in a court with jurisdiction instead of arbitration. Either party may contact or cooperate with a regulator or government agency. Disputes or remedies that cannot lawfully be required to arbitrate are excluded.
Notice, fees and hearing arrangements
Attorney-revised (Version 1.1) — not yet in force
Before filing, a party should send a written dispute notice to the other party explaining the claim and requested relief. Customer notices may be sent to our support email or legal notice address; we will use your current account contact. The parties will make a reasonable good-faith effort to resolve the dispute for 30 days after receipt. This process does not bar a timely filing needed to preserve a claim, urgent relief or a qualifying small claim. Any agreed delay will include written tolling of applicable deadlines.
The applicable AAA consumer fee schedule and fee-waiver provisions govern consumer charges. We will pay our required share and any additional amount required by law or the Consumer Due Process Protocol to keep arbitration accessible. No automatic prevailing-party fee shifting applies except as authorized by law. Remote or documents-only proceedings and any hearing location will be determined under the AAA rules, taking account of fair access and the consumer's residence.
Thirty day opt out
Attorney-revised (Version 1.1) — not yet in force
You may opt out of this Arbitration Agreement by sending notice to arbitration@67delivery.com or our legal notice address within 30 days after you first accept it. Email is sufficient; certified mail is not required. Include your name, the account email or telephone number, and a clear statement that you opt out. Do not send a copy of your identification. We will acknowledge the notice. Opting out does not affect ordinary service eligibility, and the remaining Customer Terms continue to apply. Preserve a copy and delivery evidence.
Delegation clause
Attorney-revised (Version 1.1) — not yet in force
A court with jurisdiction will determine whether the parties made an arbitration agreement or delegation agreement, which agreement controls if contracts conflict, and any other question applicable law requires a court to decide. A court also determines the enforceability of the Class and representative proceedings provision in section 4 where required by law. Subject to these reservations, the arbitrator determines interpretation, applicability, scope and enforceability of this Arbitration Agreement. Incorporation of AAA rules does not override the express court reservations.
Mass arbitration
Attorney-revised (Version 1.1) — not yet in force
If demands qualify for mass arbitration under the AAA's then-applicable rules, including the applicable consumer threshold of 25 or more similar demands with coordinated representation against the same or related parties, the AAA supplementary procedures apply. The AAA or appointed neutral decides administrative and procedural issues within its authority. Each claimant retains an individual claim and the right to an individual determination of the merits.
No automatic bellwether stay or queue is imposed by these Terms. After disputes arise, affected parties may agree in writing to a bounded bellwether, administrative batching or mediation process approved by the AAA or appropriate neutral. Such an agreement must state selection criteria, a fixed end date, fee treatment and tolling, protect urgent and deadline-sensitive claims, and preserve a route to individual resolution if the agreed process ends without settlement. A nonparticipant is not bound on the merits by another claimant's award. Administrative coordination does not excuse required fees or extinguish nonselected claims.
Failure of administration
Attorney-revised (Version 1.1) — not yet in force
If the AAA declines or cannot administer, the parties may agree to another qualified administrator applying materially equivalent consumer protections. If no such agreement is reached within 30 days after written notice of the problem, either party may proceed in a competent court. A party may not rely on this provision to obtain an advantage from its own refusal to pay required fees or comply with administration requirements. An invalid mass procedure may be severed without eliminating valid individual arbitration or access to an available court.
Class and representative proceedings
Attorney-revised (Version 1.1) — not yet in force
To the extent lawful, covered claims must proceed individually, and neither party may pursue class, collective, class-wide arbitration or representative claims on behalf of others. Coordinated filing or administration of separate individual claims under the Mass arbitration provision in section 4 is not prohibited class arbitration. This waiver does not eliminate a non-waivable remedy or government enforcement. If this waiver is unenforceable for a particular claim or remedy, that claim or remedy proceeds in the competent court to the extent required, while valid individual arbitrable claims remain subject to this Agreement. No class arbitration is authorized without the parties' express written consent after a dispute arises.
Limitation of liability
Attorney-revised (Version 1.1) — not yet in force
We will provide Platform services with reasonable care and comply with duties that applicable law does not permit us to exclude. Partners are responsible for their merchandise and lawful retail operations. Except for expressly stated commitments and mandatory warranties, the Platform is provided as available and we do not guarantee uninterrupted access, a particular delivery time or availability of every listed item. These qualifications do not excuse a required refund, payment correction or our own non-waivable duty.
To the maximum extent permitted by law, our aggregate liability to you for claims arising from the Platform is limited to the greater of $100 or the total Platform service and delivery fees you actually paid to 67 Delivery during the six months preceding the event giving rise to the claim. For this calculation, retailer merchandise amounts, taxes and driver tips are excluded. For an ongoing or related series of events, the period is measured from the first event.
This cap and the following damages exclusion do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, required refunds or payment corrections, statutory damages or other remedies that cannot lawfully be limited, or any liability that applicable law prohibits us from excluding. We do not exclude rights simply because a dispute proceeds in arbitration.
Subject to those exceptions, we are not liable for indirect, incidental, special or consequential loss, lost profits or lost business opportunities to the extent the exclusion is lawful. This section is separate from the Arbitration Agreement. An unenforceable limitation will not be applied to the extent of its invalidity, and severability is governed by section 12.
Customer indemnity
Attorney-revised (Version 1.1) — not yet in force
You will indemnify 67 Delivery and its officers, employees and agents against third-party claims and reasonable resulting damages, settlements and legal costs to the extent caused by your fraud; intentional age or identity misrepresentation; unauthorized payment or account use; unlawful furnishing of alcohol; unlawful conduct; infringement through content you supply; or material breach of these Terms that causes the claim. This obligation does not apply to ordinary good-faith complaints, lawful chargebacks or losses caused by an indemnified party's negligence, unlawful conduct or breach.
We will give prompt notice and reasonable information about a covered claim. Late notice reduces your obligation only to the extent of actual prejudice. You may control the defense with competent counsel reasonably acceptable to us; we may participate at our expense, with reasonable conflict counsel costs allocated to the responsible party where necessary. Neither party may settle a claim in a way that admits fault or imposes payment, an obligation or a restriction on the other without that party's written consent, not unreasonably withheld. Shared losses are allocated according to each party's contribution. This is a third-party indemnity, not an unrestricted right to debit your payment account.
Effective date, changes and general provisions
Attorney-revised (Version 1.1) — not yet in force
This Policy takes effect on the stated effective date (October 18, 2026) following the applicable affirmative acceptance. Sections 5 and 6 bind only the Partner or Driver who separately accepts the relevant Agreement. Schedule 2 authorization is separately obtained; no service-agreement acceptance alone authorizes screening. The Privacy Policy describes information practices and does not authorize unrelated marketing.
For disputes outside arbitration, including a valid opt-out, Florida law applies subject to mandatory applicable protections, and proceedings may be brought in a competent court with lawful jurisdiction and venue. These Terms do not require a consumer to surrender a venue or right that law makes non-waivable.
We may amend these Terms prospectively by publishing a new version and effective date. We will give reasonable notice of material changes and obtain renewed acceptance where required. Changes do not retrospectively alter pending disputes or accrued rights without valid agreement. For a material arbitration change, we will provide a fresh 30-day opt-out opportunity following acceptance of the revised agreement. A modification will not be inferred merely from access to a privacy notice.
A failure to enforce a provision is not a waiver. If a provision is invalid, it is severed only to the extent lawful while the remaining provisions continue, subject to the special rules in section 4. Notices may be provided electronically through a supported account workflow or stated contact channel, with an accessible copy available. These Terms and order-specific disclosures accepted by you govern customer services; a promotion cannot silently override dispute terms. Questions and delivery issues should be directed to support.
